These terms govern your use of The Megawatt Report newsletter, archive, charts, and datasets (the "Service"), published by {{PUBLISHER_LEGAL_NAME}} ("we"). By subscribing or using the Service you accept them. Subscriptions, payments, and accounts are handled by Substack, Inc., and Substack's own terms also apply. If the two conflict on payments or accounts, Substack's terms govern.
The Service compiles and analyzes publicly available information about data center development, electric power, and land use, including government filings, company press releases, and news reports. We do not have access to, and do not publish, non-public information.
While your subscription is active, we grant you a limited, non-exclusive, non-transferable license to read the Service and to use it, including the datasets, for your own internal business or personal purposes.
You may not:
Underlying facts and government records remain free for anyone to use. This license covers our selection, arrangement, analysis, charts, and writing.
Paid plans renew automatically at the then-current price until cancelled. You can cancel at any time in your Substack account settings, and access continues until the end of the paid period. Refunds follow Substack's process and are at our discretion unless the law requires otherwise. We will give at least 30 days' notice of a price increase for existing subscribers.
The Service is provided "as is" and "as available". We work to be accurate (see Methodology and Corrections), but our information comes from third parties and may be incomplete, delayed, or wrong. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or investment losses, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.
Company, utility, and government names are used only to identify the subject of factual reporting. Their use does not imply affiliation, sponsorship, or endorsement. Links to third-party sites are provided for attribution and verification. We are not responsible for their content.
We may update these terms. Material changes will be announced in the newsletter at least 14 days before they take effect. We may suspend or terminate access for breach of Section 3.
These terms are governed by the laws of {{GOVERNING_STATE}}, United States, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in {{GOVERNING_VENUE}}.
Not investment, legal, or engineering advice. The Megawatt Report is a general-circulation research publication. It does not give personalized advice and does not recommend buying, selling, or holding any security, property, or asset. Nothing in it is an offer or solicitation. Do your own diligence and consult qualified advisers before acting.
Announced is not built. Megawatt figures are capacities stated by developers, utilities, or reporters. They are not energized load, and announced projects are often delayed, resized, or cancelled. Unless labeled otherwise, totals count only projects whose size a source states, so they are a floor, not an estimate of the market.
Conflicts of interest. {{CONFLICTS_DISCLOSURE: e.g. "The publisher holds no positions in companies covered" or a list of holdings and a trading policy}}
Each week an automated pipeline collects items from these sources, and an editor reviews them:
Every item in an issue links to its source.
The pipeline keeps an item only if it contains a concrete fact: a megawatt, acreage, square-footage, or dollar figure; a filing; or a zoning, grid, or transaction decision tied to a named place or company. Commentary is excluded.
A project's size is counted only when its source states a single unambiguous figure. Generation capacity is never added to data center load. Stalled, rejected, and delayed projects are reported separately and never counted as pipeline.
Charts are drawn only when the week's data supports them.
News search data: The GDELT Project (gdeltproject.org).
If we get something wrong, we fix it. Send the issue date, the item, and a source for the correct information to {{CONTACT_EMAIL}} with "Correction" in the subject line. Confirmed errors are corrected in the archive, with a dated note, and listed in the next issue. Companies named in an item may submit a factual response, and we will link it.
We report facts in our own words, with attribution and a link to the original. We do not republish articles. Quotes are limited to short phrases, in quotation marks and attributed.
Rights holders who believe material in the Service infringes their copyright, or who want their site excluded from our collection, can email {{CONTACT_EMAIL}} with "Takedown" in the subject. Please include:

What it does: once a week it reads public RSS feeds, government APIs (SEC EDGAR, Federal Register), the GDELT API, and company newsroom pages, looking for data center infrastructure news. It reads full text only from government records and press releases. It does not fetch articles from news publishers.
How it behaves:
